Judge
sentences Duley brothers for Cave Creek aggravated assault

DESERT
FOOTHILLS – A Maricopa County Superior Court judge late last
month sentenced a North Valley man to 30 days in jail for
physically attacking a Cave Creek dentist last year. The judge
placed that man’s brother on probation for his role in the
assault, which took place at a Cave Creek bar and restaurant.
Judge
Margaret Mahoney sentenced Jay Duley, 24, to one month in
jail and Charles Richard “C.R.” Duley, 26, to three years
probation. Mahoney ordered both men to pay $1,000 each in
restitution.
The
Duley brothers in late November 2006 each pleaded guilty to
one count of aggravated assault and were found guilty on Jan.
26, according to court filings.
The
brothers on April 1, 2006, assaulted Dr. Kevin Harris inside
Harold’s Cave Creek Corral.
In
a written statement to Maricopa County Sheriff’s deputies,
Harris said the attack was “an unprovoked confrontation.”
He
told investigators, “One of them grabbed me by the back of
the head and pushed my face into the bathroom door,” according
to the sheriff’s report. Harris was treated at a Scottsdale
hospital immediately after the assault and later told investigators
he had suffered kidney damage and a concussion.
Mahoney
also ordered the Duley brothers to complete 100 hours of community
service, to abstain from drinking alcohol, and to not have
contact with each other, according to court records.
Attorneys
representing the brothers did not return calls placed by The
Desert Advocate seeking comment.
